Materials Handling:

Any materials provided during the design process will not be kept unless requested by the client.

Client Responsibility:

Clients are responsible for observing the copyright of third parties in relation to the material posted on their website.

Attribution:

A small link advertising TOBY DESIGN will appear in the website footer unless the client requests its removal.

Portfolio Usage:

TOBY DESIGN reserves the right to include the client’s website in their portfolio.

Suspension of Work:

TOBY DESIGN may stop work for any client suspected of engaging in illegal activities with the created website.

Cancellation Policy:

Clients must cancel contracted work promptly, and the cancellation needs confirmation in writing from TOBY DESIGN. Deposits are non-refundable, and full cost may apply if cancelling last minute after design completion.

Payment Terms:

Invoices are due on the invoice date, unless otherwise stated. All deposits are non-refundable, exceptions at the discretion of TOBY DESIGN.

Direct Debit and Overdue Payments:

Direct debit payments continue until written cancellation. Overdue payments may lead to hosting cancellation, rendering the site offline until funds are received.

Outstanding Balances:

Liability for outstanding balances rests with the individual who opened the account.

Turnaround Times:

Turnaround times are estimates and may extend past the given estimate. Turnaround time starts from the first full working day after deposit receipt.

Copyright:

TOBY DESIGN retains copyright on design work until the full balance is paid.

Liability for Errors:

TOBY DESIGN accepts no liability for errors post-service completion; clients are responsible for checking all content before the site goes live.

Jurisdiction:

The contract between the client and TOBY DESIGN is under the exclusive jurisdiction of the courts of England and Wales.
